Terms & Conditions
Effective Date: [10/07/2026]
Last Updated: [LAST UPDATED DATE]
These Terms and Conditions (hereinafter referred to as the “Terms,” “Terms and Conditions,” or “Agreement”) constitute a legally binding agreement between [LEGAL BUSINESS NAME], doing business as Golden Door Dog Training (hereinafter referred to as “Golden Door Dog Training,” the “Company,” “we,” “us,” or “our”), and the individual or entity accessing, purchasing, registering for, participating in, or otherwise using any of the Company's products or services (hereinafter referred to as the “Client,” “Customer,” “User,” “you,” or “your”).
These Terms govern your access to and use of our website, digital products, online dog training programs, courses, memberships, communities, educational materials, consultations, private training, day training, Board & Train programs, boarding services, events, communications, downloadable resources, and any other products or services offered by the Company (collectively, the “Services”).
By accessing our website, purchasing a product or Service, submitting payment, creating an account, enrolling in a program, signing an agreement, clicking a button indicating acceptance, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree to these Terms, you should not purchase, access, or use the Services.
Additional agreements, including without limitation training agreements, Board & Train agreements, boarding agreements, veterinary authorizations, media releases, waivers, order forms, enrollment agreements, subscription terms, payment plans, or other written agreements, may apply to particular Services.
In the event of a direct conflict between these Terms and a separately executed written agreement specifically governing a particular Service, the more specific agreement shall control with respect to that Service.
ELIGIBILITY
The Services are generally intended for individuals who are eighteen (18) years of age or older and legally capable of entering into a binding agreement.
By purchasing or using the Services, you represent and warrant that you possess the legal authority to enter into this Agreement.
If you purchase or use the Services on behalf of another person, household, organization, or entity, you represent and warrant that you have authority to bind such person or entity to these Terms.
NATURE OF DOG TRAINING SERVICES
Golden Door Dog Training provides educational, instructional, and hands-on dog training services designed to improve communication, behavior, obedience, reliability, relationship, and other training outcomes.
Training methods may include, without limitation, play, food rewards, praise, marker training, leash pressure, spatial pressure, boundaries, repetition, reinforcement, consequences, corrections, training equipment, environmental exposure, socialization, behavior modification, and other training techniques selected by the Company based upon the dog, Client, circumstances, and training objectives.
You acknowledge that dog training is not an exact science and that animals are living beings whose behavior may be unpredictable and may change depending upon environment, genetics, prior learning history, health, stress, arousal, handling, reinforcement history, owner consistency, and numerous other variables.
Accordingly, no particular behavioral outcome can be guaranteed.
NO GUARANTEE OF RESULTS
The Company makes no representation, warranty, promise, or guarantee, express or implied, that any particular dog will achieve any specific behavioral, obedience, socialization, emotional, public-access, off-leash, or training result.
Examples, testimonials, demonstrations, photographs, videos, case studies, or descriptions of previous clients or dogs are illustrative only and shall not be construed as a representation or guarantee that you or your dog will achieve the same or similar results.
Training results depend upon numerous factors outside the Company's control, including without limitation the dog's genetics, age, physical health, temperament, behavioral history, prior training, environment, consistency, household management, reinforcement history, Client participation, and continued implementation of training.
You acknowledge that maintenance of training after completion of a program is your responsibility.
Skills may weaken, regress, or change if training, structure, reinforcement, boundaries, practice, or appropriate management are not maintained.
For the avoidance of doubt, completion of a training program does not mean that a dog will never make a mistake, display an undesirable behavior, react to a stimulus, disobey a command, become frightened, bite, escape, become injured, or otherwise behave unpredictably.
CLIENT PARTICIPATION AND RESPONSIBILITY
Successful dog training requires Client participation and consistency.
You agree to make reasonable efforts to follow instructions provided by the Company, including without limitation instructions relating to handling, communication, equipment, reinforcement, corrections, household management, crate use, leash handling, boundaries, practice, and maintenance.
You acknowledge that failure to follow instructions may materially affect training results.
The Company shall not be responsible for deterioration, regression, failure to progress, or undesirable behavior resulting from inconsistent implementation, failure to follow instructions, misuse of training equipment, changes in the dog's environment, interference by third parties, or other matters outside the Company's reasonable control.
ACCURACY AND DISCLOSURE OF INFORMATION
You agree to provide complete, truthful, and accurate information concerning your dog before and during the provision of Services.
Without limiting the foregoing, you agree to disclose any known or suspected:
Aggression.Bite history.Attempted bites.Human-directed aggression.Dog-directed aggression. Animal-directed aggression.Resource guarding.Reactivity. Fear.Anxiety.Escape behavior.Separation-related behavior.Destructive behavior.History of fighting.Predatory behavior.Sensitivity to handling.Medical condition.Injury.Pain.Allergy.Medication.Dietary restriction.Contagious disease.Parasite.Vaccination concern.Veterinary restriction.Prior use of training equipment.Behavioral medication.
Other behavior or medical circumstance that could reasonably affect the safety, handling, care, or training of the dog.
You understand and agree that failure to disclose material information may place the dog, Company, trainers, staff, contractors, members of the public, other animals, and property at risk.
The Company reserves the right to refuse, modify, suspend, or terminate Services if material information was omitted, concealed, or misrepresented.
DOG OWNERSHIP AND AUTHORITY
By enrolling a dog in any Service, you represent and warrant that you are the legal owner of the dog or have full legal authorization from the dog's owner to enroll the dog, authorize training, make medical decisions as provided herein, and enter into agreements concerning the dog.
You further represent that there are no ownership disputes, legal restrictions, court orders, dangerous-dog restrictions, quarantine orders, or other limitations affecting the Company's possession, handling, transport, training, or care of the dog unless expressly disclosed to us in writing before Services begin.
HEALTH AND VETERINARY REQUIREMENTS
You represent that, to the best of your knowledge, any dog participating in in-person Services is in suitable physical condition to participate in the applicable training or boarding activities.
The Company reserves the right to request vaccination records, veterinary documentation, fecal testing, health information, or other records where reasonably appropriate.
You agree to notify the Company promptly of any illness, injury, infectious condition, medication change, veterinary restriction, or significant health condition occurring before or during Services.
The Company may refuse or discontinue Services if we reasonably believe a dog's health condition creates a risk to the dog, another animal, a person, or the operation of the Company.
VETERINARY EMERGENCIES
If a dog in the Company's custody becomes ill, injured, or otherwise appears to require veterinary attention, the Company will make reasonable efforts to contact you or your designated emergency contact.
If you or your emergency contact cannot reasonably be reached, or if circumstances reasonably require prompt treatment, you authorize the Company to seek veterinary examination, diagnostic testing, emergency treatment, medication, hospitalization, transportation, or other veterinary care that the Company reasonably determines to be necessary or appropriate for the dog's health or welfare.
You authorize the treating veterinarian to provide such care.
Unless otherwise required by applicable law or caused by conduct for which liability cannot lawfully be limited, all veterinary costs and related expenses shall remain your responsibility.
You agree to reimburse the Company for veterinary, transportation, medication, emergency, or related costs advanced on your behalf.
The Company does not warrant or guarantee the availability, actions, diagnosis, treatment, or outcome of any third-party veterinary provider.
NO VETERINARY SERVICES
Golden Door Dog Training is not a veterinary practice.
Nothing contained within our Services, courses, content, communications, training recommendations, or educational materials shall be construed as veterinary diagnosis, treatment, or medical advice.
Questions concerning your dog's medical condition, medication, nutrition, injury, physical limitations, or veterinary care should be directed to a licensed veterinarian.
Where behavior may have a medical component, the Company may recommend that you consult a veterinarian or veterinary behavior professional.
TRAINING METHODS AND EQUIPMENT
You acknowledge that Golden Door Dog Training uses balanced dog training methods.
Depending upon the dog and applicable program, training may include the use of food, toys, play, praise, marker training, leashes, long lines, slip leads, flat collars, martingale collars, crates, place beds, prong collars, remote electronic training collars commonly referred to as “e-collars,” or other appropriate training equipment.
You understand and authorize the Company to select and utilize training methods and equipment that the Company reasonably determines are appropriate for the dog and training objectives, subject to applicable law and any separately agreed limitations.
Training equipment may involve pressure, release of pressure, correction, interruption, or other forms of consequence.
You acknowledge that no training tool is entirely without risk and that improper use of training equipment by any person may result in injury, discomfort, behavioral deterioration, or unintended consequences.
Where the Company teaches you to use training equipment, you agree to use the equipment according to the instructions provided.
The Company is not responsible for injury, behavioral problems, equipment malfunction, or other consequences resulting from your misuse, modification, improper fit, use contrary to instructions, or use by another person after the dog leaves our custody.
E-COLLAR TRAINING
Where appropriate to a program, remote electronic collars may be used as part of the training process.
You acknowledge that the purpose of an e-collar within our training system is to provide clear, consistent remote communication and accountability after or in conjunction with teaching and conditioning.
You authorize the Company to determine appropriate equipment, fit, conditioning protocols, and training levels based on the dog and training objectives.
You understand that the Company's use or recommendation of an e-collar does not eliminate the need for proper handling, supervision, management, reinforcement, leash use where appropriate, or continued training.
PRONG COLLARS AND OTHER TRAINING TOOLS
The Company may use or recommend properly fitted prong collars, slip leads, long lines, leashes, crates, and other training tools where reasonably appropriate.
You acknowledge that training equipment must be properly fitted, maintained, supervised, and used.
You agree not to materially alter or misuse equipment contrary to instructions provided by the Company.
ASSUMPTION OF RISK
You acknowledge and understand that interacting with, handling, transporting, boarding, exercising, training, and caring for dogs involves inherent and sometimes unpredictable risks.
Such risks may include, without limitation:
Bites.Scratches.Falls.Trips.Collisions.Dog fights.Escape.Running away.Ingestion of foreign objects.Illness.Exposure to contagious conditions.Allergic reactions.Heat-related illness.Stress.Behavioral regression.Injury from another animal.Injury to another animal.Injury to a person.Property damage.Vehicle-related risks.Risks associated with public environments.Equipment malfunction.Risks associated with training tools.Risks inherent in play, exercise, walking, running, jumping, climbing, swimming, socialization, transport, or other normal dog-related activities.
You voluntarily assume the ordinary and inherent risks associated with dog ownership and participation in the Services to the fullest extent permitted by applicable law.
Nothing herein shall be construed as waiving liability that cannot lawfully be waived under applicable law.
AGGRESSIVE, REACTIVE, OR HIGH-RISK DOGS
You acknowledge that dogs with histories of aggression, biting, reactivity, fear, predatory behavior, or other serious behavioral concerns may present increased risk.
The Company may require additional safety measures, including without limitation muzzles, leashes, crates, barriers, specific equipment, restricted handling, controlled environments, or other management protocols.
The Company reserves the right to modify, suspend, or discontinue a particular training activity if we reasonably determine that continuation would create an unacceptable safety risk.
No training program can guarantee that aggression, biting, reactivity, fear, or other dangerous behavior will never recur.
BOARD & TRAIN SERVICES
Dogs enrolled in Board & Train programs will remain in the Company's care for the period specified in the applicable booking confirmation, invoice, proposal, order form, or training agreement.
Training length may vary based upon the program selected, the dog's progress, health, behavior, and other circumstances.
Any estimated training timeline is an estimate only unless expressly guaranteed in writing.
You acknowledge that a Board & Train program requires a transition back to the owner.
The dog's ability to perform behaviors with the trainer does not necessarily mean the dog will immediately perform identically for you.
Transfer sessions, go-home instruction, continued practice, consistent handling, appropriate training equipment, structure, and follow-through may be necessary to maintain and transfer training.
You agree to participate in any required go-home or transfer instruction and to make reasonable efforts to follow the Company's maintenance recommendations.
BOARDING SERVICES
Boarding services may be offered to eligible dogs, including training graduates, subject to availability and the Company's policies in effect at the time of booking.
Boarding reservations are not guaranteed until accepted by the Company.
Rates, holiday charges, minimum stays, deposits, cancellation policies, pickup and drop-off requirements, and other boarding conditions may be stated at the time of booking and are incorporated herein by reference.
The Company reserves the right to decline boarding services for any dog where we reasonably determine the dog cannot safely or appropriately be accommodated.
FOOD, MEDICATIONS, AND PERSONAL PROPERTY
Where a dog stays in the Company's custody, you agree to provide accurate feeding instructions, medication instructions, and any other material care information.
Medications must be provided in appropriate containers with accurate instructions unless otherwise agreed.
The Company will make reasonable efforts to follow feeding and medication instructions but does not guarantee exact timing to the minute unless medically required and expressly agreed.
You acknowledge that changes in environment, activity, stress, training, appetite, or routine may cause temporary changes in eating, drinking, bowel movements, sleep, or behavior.
The Company is not responsible for loss or damage to personal belongings, bedding, toys, collars, leashes, bowls, or other items sent with a dog, except to the extent required by law.
TRANSPORTATION AND PUBLIC TRAINING
You authorize the Company and its authorized trainers, staff, or contractors to transport your dog where reasonably necessary or appropriate to provide Services.
Transportation may include travel by motor vehicle to training locations, veterinary providers, public environments, parks, retail areas, or other locations appropriate for training or care.
You further authorize the Company to train your dog in reasonable real-world environments selected by the Company, including without limitation neighborhoods, parking areas, stores permitting dogs, outdoor spaces, veterinary environments, restaurants or patios where dogs are permitted, and other public or private training locations.
You acknowledge that real-world training inherently involves environmental variables outside the Company's control.
OFF-LEASH TRAINING
Certain programs may include off-leash or long-line training.
You acknowledge that no dog is incapable of making an unexpected decision and that off-leash activity carries inherent risk, including escape, collision, injury, interaction with wildlife, interaction with people or animals, or failure to respond to a command.
The Company may use reasonable safety measures during off-leash training but cannot guarantee that a dog will never fail to respond.
Following completion of Services, the decision whether and where to allow your dog off leash is solely yours.
You are responsible for complying with all leash laws, property rules, public-access requirements, and other applicable regulations.
SERVICE DOG AND PUBLIC-ACCESS TRAINING
Where the Company provides advanced obedience, service-dog-related training, public-access preparation, or similar training, the Company does not guarantee that any particular dog will qualify as a service animal, successfully complete public-access training, meet the standards of any third-party organization, or remain suitable for service work.
A dog's suitability may change based upon health, temperament, behavior, maturity, training, or other circumstances.
Nothing in our Services constitutes a legal determination that a dog meets the definition of a service animal under federal, state, or local law.
The Client remains responsible for understanding and complying with laws applicable to service animals and public access.
SCHEDULING, CANCELLATIONS, AND RESCHEDULING
Appointments, private sessions, evaluations, consultations, transfer sessions, or other scheduled Services must be scheduled according to the Company's procedures.
Unless a different cancellation policy is disclosed for a particular Service, we request at least twenty-four (24) hours' notice for cancellation or rescheduling of an appointment.
The Company reserves the right to treat appointments cancelled with insufficient notice, or missed appointments, as completed and non-refundable where disclosed at booking or permitted by applicable law.
Late arrival by the Client may result in a shortened appointment without reduction in price.
The Company may reschedule a session due to illness, emergency, weather, safety concerns, dog-related circumstances, scheduling conflicts, or other reasonable circumstances.
PURCHASES AND PAYMENT
Prices for Services shall be those stated on the Company's website, checkout page, proposal, invoice, order form, enrollment agreement, or other applicable offer at the time of purchase.
All prices are stated in United States Dollars unless otherwise indicated.
You agree to pay all amounts associated with your purchase, including applicable taxes, fees, deposits, payment-plan installments, or other charges disclosed at or before purchase.
By providing a payment method, you represent that you are authorized to use the payment method and authorize the Company and its payment processors to charge amounts due under the applicable purchase.
PAYMENT PLANS
Where a payment plan is offered, the payment plan constitutes a payment arrangement for the full purchase price unless expressly stated otherwise.
Cancellation of participation in a program does not automatically cancel amounts owed under a fixed payment plan.
Unless otherwise expressly stated in writing, choosing to stop participating, failing to access digital materials, failing to attend calls, failing to complete training, or deciding that you no longer wish to participate does not relieve you of amounts already owed under a binding payment arrangement.
If a scheduled payment fails, the Company may attempt to process the payment again and may suspend access to Services until the account is brought current.
To the extent permitted by law, you remain responsible for outstanding amounts due under your agreement.
SUBSCRIPTIONS AND AUTOMATIC RENEWAL
Certain memberships, communities, support programs, digital services, or other offerings may operate on a recurring subscription basis.
If you purchase a recurring subscription, you authorize the Company or its payment processor to automatically charge the payment method on file at the frequency and rate disclosed at checkout until the subscription is cancelled.
The applicable price, billing frequency, trial period if any, and material subscription terms will be disclosed at or before purchase.
Unless otherwise stated, recurring subscriptions continue until cancelled.
You may cancel a recurring subscription using the cancellation mechanism provided through your account or by contacting us at [SUPPORT EMAIL], subject to any reasonable processing period disclosed at purchase.
Cancellation stops future renewals but does not ordinarily provide a refund for charges already incurred unless required by law or expressly provided by the applicable offer.
We may change subscription pricing upon advance notice where required by applicable law.
Where applicable law requires specific automatic-renewal notices, disclosures, reminders, or cancellation mechanisms, the Company will provide them as required.
FREE TRIALS
Where a free or discounted trial is offered, the duration and terms of the trial shall be disclosed at the time of enrollment.
If the trial converts automatically into a paid subscription, such conversion and the applicable recurring price will be disclosed at or before enrollment.
You are responsible for cancelling before the applicable renewal date if you do not wish to continue after the trial.
REFUNDS
Except where a specific written refund policy or guarantee is expressly stated for a particular offer, or where otherwise required by applicable law, all sales are final and non-refundable once access to a digital product, course, program, membership, downloadable material, or other digital content has been provided.
For in-person Services, deposits, reservation fees, completed Services, training already performed, boarding already provided, and costs already incurred by the Company are non-refundable except where otherwise expressly agreed or required by law.
If a specific product or program includes a refund period, satisfaction guarantee, performance guarantee, or other refund policy, the terms stated in the applicable offer shall govern that purchase.
No verbal representation shall modify the written refund policy applicable to a purchase.
The Company reserves the right, in its sole discretion, to issue a refund, credit, transfer, or other accommodation in circumstances where no refund is contractually required. Any such accommodation in one instance shall not obligate the Company to provide the same accommodation in another instance.
Nothing contained herein shall limit a refund right that cannot lawfully be waived.
CHARGEBACKS AND PAYMENT DISPUTES
You agree to contact the Company at [email protected] in good faith regarding a payment dispute before initiating a chargeback where reasonably practicable.
A chargeback does not automatically terminate a valid payment obligation.
Where a chargeback is initiated for a validly authorized transaction and the Company reasonably believes the chargeback is improper, the Company may provide transaction records, acceptance records, usage records, communications, signed agreements, IP logs, or other relevant information to the payment processor or financial institution.
The Company reserves all rights and remedies available for unpaid amounts.
DIGITAL PRODUCTS AND ONLINE PROGRAMS
Digital products and online Services are licensed to you for your personal use only unless the Company expressly authorizes another use in writing.
Purchasing a digital product does not transfer ownership of the product, curriculum, course, video, PDF, manual, workbook, photograph, graphic, process, methodology, trademark, or other intellectual property.
You may not, without the Company's prior written permission:
Share account credentials.
Allow another person to access a paid account using your credentials.
Copy or reproduce course materials for distribution.
Record paid courses or calls for redistribution.
Screen-record or download materials where downloading is not expressly permitted.
Upload Company content to another website or platform.
Resell Company materials.
Teach or sell Company's proprietary curriculum as your own.
Create derivative commercial products substantially based upon Company materials.
Publish paid content publicly.
Distribute PDFs, e-books, manuals, videos, worksheets, or training materials to third parties.
Circumvention of access controls or unauthorized distribution may result in immediate termination of access without refund and may subject the responsible party to available legal remedies.
INTELLECTUAL PROPERTY
All content made available through the Services, including without limitation trade names, trademarks, logos, branding, photographs, graphics, videos, audio recordings, written content, training systems, methodologies, course structures, worksheets, manuals, e-books, downloads, lessons, presentations, designs, website content, and other materials are owned by or licensed to the Company and are protected by applicable intellectual property laws.
Golden Door Dog Training grants you a limited, revocable, non-exclusive, non-transferable license to use purchased educational materials solely for your own personal, non-commercial dog training purposes, subject to these Terms.
No ownership interest is transferred to you.
All rights not expressly granted are reserved.
ACCOUNT SECURITY
You are responsible for maintaining the confidentiality of your username, password, and account credentials.
You may not sell, transfer, share, lend, or otherwise provide account access to another person unless expressly authorized.
You agree to notify the Company promptly if you become aware of unauthorized use of your account.
The Company reserves the right to suspend or terminate accounts where we reasonably suspect unauthorized sharing, fraudulent activity, abuse, security risk, or violation of these Terms.
COMMUNITY STANDARDS
Participation in any Company community, membership group, Q&A, forum, video call, social group, or interactive platform is a privilege and is subject to reasonable standards of conduct.
You agree not to engage in harassment, threats, bullying, discrimination, illegal activity, solicitation, spam, impersonation, intentional disruption, unauthorized advertising, disclosure of another person's confidential information, theft or redistribution of Company materials, or conduct reasonably determined by the Company to materially interfere with the community.
The Company reserves the right to moderate content and to remove any participant whose conduct materially violates these Terms or creates a safety, legal, operational, or community concern.
Where reasonably appropriate, access may be terminated without refund for serious or repeated violations.
GROUP CALLS AND COMMUNITY INFORMATION
You acknowledge that information voluntarily shared during group programs, communities, or Q&A calls may be heard, viewed, or accessed by other participants.
Although the Company may request that participants respect one another's privacy, the Company cannot guarantee that another participant will maintain confidentiality.
Accordingly, you should not disclose information during a group setting that you are unwilling to have known by other participants.
RECORDINGS OF ONLINE CALLS
Certain webinars, educational sessions, Q&A calls, group calls, or similar online sessions may be recorded.
Where a session is recorded, the Company may provide notice through the program, meeting platform, invitation, or other reasonable means.
By voluntarily participating in a recorded group session after receiving notice, you acknowledge that your name, voice, image, comments, or participation may appear in the recording.
Separate consent may be requested for use of identifiable recordings in external marketing where required or appropriate.
PHOTOGRAPHS, VIDEO, AND MEDIA
The Company may photograph or record dogs participating in training for purposes including documenting progress, communicating with Clients, training review, education, business records, and, where separately authorized or otherwise permitted, marketing.
Public use of a Client's identifiable name, image, likeness, voice, testimonial, or other personally identifying media may be subject to a separate media authorization, release, or consent where appropriate.
Nothing in these Terms shall be construed to require you to grant the Company unrestricted commercial use of your personal likeness merely as a condition of receiving ordinary Services unless such authorization has been separately and conspicuously agreed.
TESTIMONIALS AND REVIEWS
If you voluntarily provide a testimonial, review, photograph, video, success story, or similar content for promotional use, you represent that the content reflects your genuine experience and that you have authority to provide it.
Any specific authorization for the Company to reproduce your identifiable testimonial, likeness, photograph, video, or voice may be governed by a separate release or consent.
LIFETIME ACCESS AND LIFETIME SUPPORT
Certain products or Services may be described as providing “lifetime access,” “lifetime support,” or similar benefits.
Unless expressly stated otherwise in writing, “lifetime” refers to the commercial lifetime of the applicable product, program, platform, support service, or Company offering—not the lifetime of the purchaser, dog, trainer, owner, or any particular individual.
Lifetime access does not constitute a guarantee that a specific website, application, platform, community, employee, trainer, technology provider, course format, call schedule, or method of support will exist indefinitely.
The Company reserves the right to update, replace, migrate, reorganize, modify, consolidate, or discontinue platforms, content, support methods, or delivery mechanisms when reasonably necessary.
Where practical, the Company may provide a reasonable substitute or alternative method of access for materially equivalent content.
“Lifetime support” for training graduates does not mean unlimited on-demand private training, unlimited in-person sessions, emergency services, twenty-four-hour availability, or perpetual access to the owner personally unless expressly stated otherwise.
The scope, method, timing, and availability of support may be reasonably determined by the Company.
CHANGES TO PROGRAMS OR SERVICES
The Company continually develops and improves its Services.
Accordingly, we reserve the right to modify curricula, lessons, course order, training methods, software platforms, community platforms, call schedules, instructors, training locations, support methods, included resources, or other operational components of a Service where the fundamental nature of the purchased Service is not materially eliminated.
We may substitute substantially similar materials, services, trainers, platforms, or features when reasonably necessary.
TERMINATION BY THE COMPANY
The Company may refuse, suspend, or terminate Services where reasonably necessary because of:
Nonpayment.Fraud.Threats.Harassment.Unsafe conduct.Abuse toward an animal or person.Material misrepresentation.Failure to disclose significant behavioral or medical information.Violation of these Terms.Unauthorized distribution of intellectual property.Account sharing.Illegal conduct.Serious community misconduct.A material safety risk.A dog that the Company reasonably determines it can no longer safely accommodate.Circumstances making continued performance unlawful or impracticable.
Any refund following termination by the Company shall be determined based upon the circumstances, Services already performed, costs incurred, applicable offer terms, and applicable law.
TERMINATION BY CLIENT
You may discontinue using the Services at any time.
Discontinuation does not automatically entitle you to a refund or cancel payment obligations already incurred under a purchase, payment plan, reservation, or other agreement.
Recurring subscriptions may be cancelled in accordance with the applicable subscription terms.
THIRD-PARTY PRODUCTS AND SERVICES
The Company may recommend or reference products, equipment, websites, trainers, veterinarians, software, payment processors, course platforms, retailers, manufacturers, or other third parties.
Unless expressly stated otherwise, third parties are independent from the Company.
We do not control and are not responsible for the acts, omissions, products, representations, warranties, availability, security, privacy practices, or services of third parties.
Any transaction between you and a third party is subject to that third party's terms.
AFFILIATE LINKS
The Company may from time to time use affiliate links or referral arrangements through which the Company may receive compensation if you purchase a product or service.
Where legally required, material affiliate relationships will be disclosed.
You are under no obligation to purchase a recommended product through an affiliate link.
DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, CONTENT, MATERIALS, AND INFORMATION PROVIDED BY THE COMPANY ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
EXCEPT AS EXPRESSLY SET FORTH IN A WRITTEN AGREEMENT, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, OR RESULTS.
THE COMPANY DOES NOT WARRANT THAT DIGITAL SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR AVAILABLE AT ALL TIMES.
Nothing herein shall exclude warranties or rights that cannot lawfully be excluded.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, TRAINERS, AGENTS, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, LOSS OF USE, OR OTHER CONSEQUENTIAL LOSS ARISING OUT OF OR RELATED TO THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PURCHASE OR SERVICE SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO THE COMPANY BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
The foregoing limitations shall apply to the fullest extent permitted by applicable law regardless of the legal theory asserted.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited, including liability where an exclusion would be prohibited by applicable law.
DOG-RELATED LIABILITY
You acknowledge that dog ownership carries legal and practical responsibilities independent of the Company's training Services.
Except to the extent prohibited by applicable law or directly caused by conduct for which the Company cannot lawfully limit liability, you remain responsible for your dog's conduct and for complying with applicable laws concerning ownership, control, confinement, licensing, vaccination, leash requirements, bites, dangerous dogs, and injuries or damage caused by your dog.
Completion of training does not transfer ownership responsibility to the Company after the dog has been returned to you.
RELEASE AND ASSUMPTION OF RISK
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME THE ORDINARY AND INHERENT RISKS ASSOCIATED WITH PARTICIPATION IN DOG TRAINING, BOARDING, HANDLING, TRANSPORTATION, EXERCISE, AND RELATED ACTIVITIES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE AND HOLD HARMLESS THE COMPANY AND ITS OWNERS, EMPLOYEES, TRAINERS, CONTRACTORS, AGENTS, AND REPRESENTATIVES FROM CLAIMS ARISING SOLELY FROM SUCH ORDINARY AND INHERENT RISKS.
Nothing in this provision releases any party from liability that cannot lawfully be released.
INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Company and its owners, members, officers, employees, trainers, contractors, agents, affiliates, successors, and representatives from and against third-party claims, liabilities, damages, losses, judgments, costs, and reasonable attorneys' fees arising out of or relating to:
Your material breach of these Terms.
Your violation of applicable law.
Your material misrepresentation or failure to disclose relevant information concerning your dog.
Your unauthorized use or distribution of Company intellectual property.
Your misuse of training equipment following delivery of the dog to you.
Your dog's acts or conduct while the dog is under your possession or control.
Your negligent, reckless, or unlawful conduct.
This indemnification provision shall not require you to indemnify a party for conduct to the extent indemnification is prohibited by applicable law.
FORCE MAJEURE
The Company shall not be liable for delay, interruption, cancellation, or failure to perform caused by circumstances beyond its reasonable control, including without limitation natural disasters, hurricanes, tropical storms, flooding, fire, government orders, public health emergencies, epidemics, utility failures, internet outages, transportation interruptions, labor disruptions, civil disturbances, acts of war, terrorism, veterinary emergencies, serious illness, death, platform failures, supplier failures, or other events beyond reasonable control.
Where reasonably practicable, the Company may reschedule, substitute, extend, modify, or otherwise adjust affected Services.
WEBSITE AVAILABILITY
We do not guarantee uninterrupted availability of our website, online courses, community platforms, or third-party technology systems.
Temporary downtime may occur due to maintenance, updates, security incidents, third-party outages, platform changes, or circumstances beyond our control.
ERRORS AND OMISSIONS
We make reasonable efforts to provide accurate information but do not warrant that all website content, pricing descriptions, product descriptions, or other information will at all times be free from typographical, technical, or other errors.
We reserve the right to correct obvious errors and to cancel or modify an order affected by a material pricing or descriptive error, subject to applicable law.
PRIVACY
Our collection and use of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Services, you acknowledge that you have been provided an opportunity to review the Privacy Policy.
ELECTRONIC COMMUNICATIONS AND ACCEPTANCE
You consent to receive agreements, notices, disclosures, receipts, records, and other communications electronically where permitted by law.
You agree that electronic acceptance, including clicking an acceptance box, electronically signing an agreement, submitting an online purchase, or otherwise manifesting assent electronically, may constitute your signature and acceptance of these Terms to the extent recognized by applicable law.
GOVERNING LAW
These Terms and any dispute arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent federal law or another non-waivable law applies.
VENUE AND JURISDICTION
To the fullest extent permitted by applicable law, any legal action arising out of or relating to these Terms or the Services that is not otherwise subject to a separately agreed dispute-resolution provision shall be brought in a court of competent jurisdiction located in Palm Beach County, Florida.
You consent to the personal jurisdiction of such courts, subject to rights that cannot lawfully be waived.
GOOD-FAITH DISPUTE RESOLUTION
Before initiating litigation concerning a dispute arising from these Terms or the Services, the parties agree, where reasonably practicable, to make a good-faith attempt to resolve the dispute directly.
Written notice of a dispute should be sent to:
[Savanah Lammers/[email protected]]
The notice should reasonably describe the nature of the dispute and the requested resolution.
Nothing herein prevents either party from seeking emergency or injunctive relief when reasonably necessary to protect safety, confidential information, intellectual property, or other rights requiring immediate protection.
ATTORNEYS' FEES
To the extent permitted by applicable law and any applicable contract or statute, a prevailing party in a legal action arising out of a material breach of these Terms may seek recovery of reasonable attorneys' fees and costs where legally available.
Nothing herein creates a right to attorneys' fees where such recovery is prohibited by applicable law.
SEVERABILITY
If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such provision shall be enforced to the maximum extent permitted by law or, where appropriate, severed from this Agreement.
